Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the http://www.daretodreamlife.com/ website (the "Service") operated by Dare to Dream Services/Leslie Phillips Seminars® to purchase any services (seminars) (massages) offered, heninceforth the use of "we", "us," "our" will refer to Dare to Dream Services/Leslie Phillips Seminars®, Brittnee Phillips, LMT. The term “Service(s) will refer to “seminars”, “continuing education seminars”, "Massage Services", and “usage of the Dare to Dream Website to register and pay for seminars and massage services”.
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.
If you wish to purchase/register for seminars/massages made available through the Service ("Buy it Now/Purchase" PayPal Buttons), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, security code, your billing address, email address, telephone number and your shipping information. You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete. The service may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. Third party services utilized may change over time without notification to parties. By submitting your information on the service website, you grant us the right to provide the information to these third parties. We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
Availability, Errors and Inaccuracies
We are constantly updating service offerings on the Service. We may experience delays in updating information on the Service and in our advertising on other web sites, including but not limited to, if a seminar has reached full capacity, sold out, and/or not accepting more registrations, cancelled, change of seminar dates, locations, and/or speakers, and massage service availability. The information found on the Service may contain errors or inaccuracies and may not be complete or current. Products or services may be mispriced, described inaccurately, or unavailable on the Service and we cannot guarantee the accuracy or completeness of any information found on the Service. We therefore reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice. We reserve the right to refuse service, remove or edit content, or cancel orders in our sole discretion.
The Service and its original content, features and functionality are and will remain the exclusive property of Dare to Dream Services/Leslie Phillips Seminars®, Brittnee Phillips, LMT, and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. REFUNDS/CANCELLATIONS/POSTPONEMENTS FOR SEMINARS
Refunds: If a refund is requested by the participant, a partial refund, minus a $25.00 adminstrative fee will be given within two weeks of the event. All cancellations must be in writing, thus emailed to firstname.lastname@example.org is preferred. No refunds will be issued if received less than 2 weeks of the event. Please note if a participant fails to contact us as well as fails to appear for the seminar, no refunds will be issued, nor will attendance of another seminar be allowed.
Cancellations: If Leslie Phillips Seminars® cancels a seminar, a full refund will be given. Leslie Phillips Seminars® reserves the right to cancel any seminar due to low enrollment.
Postponements: At times, postponing a seminar may be unavoidable (such as illness of a presenter, family tragedy, etc). If a seminar is postponed, all registered will have the option to attend the seminar on the newly scheduled date, or have their registration transferred to another seminar of their choice within the next 6 months. No refunds will be given. If a seminar is not attended within that 6 month period, attendance of another seminar is forfeited.
BY REGISTERING FOR ANY SEMINAR, REGARDLESS OF PAYMENT METHOD, (ONLINE, OR BY SENDING A CHECK THROUGH THE MAIL), THIS DEMONSTRATES AGREEMENT TO ALL TERMS AND CONDITIONS, WHICH INCLUDES THE ABOVE POLICIES REGARDING REFUNDS, CANCELLATIONS AND POSTPONEMENTS.
Certificates: It is the policy and procedure of Leslie Phillips Seminars® to provide our customers with their certificate at the end of each seminar. Because we provide this in person, at the conclusion of all seminars, the following policy is adhered to:
1. If a customer loses, misplaces, fails to get their certificate before leaving for the day, or otherwise cannot find their certificate that was originally provided at their seminar, Leslie Phillips Seminars® will provide an additional certificate electronically with an administrative charge of $15.00. Customers may utilize the buy it now option on our website at www.daretodreamlife.com or contact email@example.com to pay by check.
2. If a customer requests a certificate to be mailed through the United States Postal Service, Leslie Phillips Seminars ® will mail the certificate with an administrative charge of $20.00. Customers may utilize the buy it now option on our website at www.daretodreamlife.com or contact firstname.lastname@example.org to pay by check.
MASSAGE SERVICES POLICIES AND PROCEDURES
Brittnee Phillips, LMT Policies and Procedures: Brittnee Phillips, LMT understands that unanticipated events occur in everyone's life. Unforeseen events such as sick children, car problems, traffic considerations, business meetings, and project deadlines, are just a few reasons why one might consider canceling a massage appointment. In my commitment to provide a unique and outstanding massage experience to all my clients and out of consideration for my time, I have adopted the following policies:
MY ARRIVAL TO YOUR SESSION I will arrive for your appointment 15 minutes prior to the scheduled starting time to allow time for set up practices. All services offered have a specific time schedule and a slightly early arrival allows for me to create a relaxed and unhurried experience. Please know that once ready, and your appointment time arrives - and you arrive late for your scheduled session, your session will be shortened in order to keep on schedule for my other clients. Full fee will be charged. Every client is important to me and since my sessions are for the full allotted time billed, I want to be able to keep everyone on schedule which helps keep everyone’s lives a little more stress free.
CANCELLATION POLICY Brittnee Phillips, LMT has a 24 hour cancellation policy. Appointments that are made same day are subject to the paying full price of the visit for a no show. The reason for this is the appointment is already within the 24 hour cancellation period when the appointment was booked. There will be a cancellation fee (thus no refunds) for any massage sessions not canceled within the 24 hour time frame.
SCHEDULING APPOINTMENTS AND PAYMENT METHODS A credit card will be required for all scheduled appointments and for all first time appointments to guarantee and reserve that time for you. If you choose to not book online (which is secured with a credit card), please know all requests made via telephone will require a credit card to reserve the appointment. However, your card will not be charged at the time of reservation. You may use it to pay for services at the completion of your appointment or some other form of payment. Your credit card will be charged the full fee in the event of a cancellation less than 24 hours or a no show/no call event. If you need to make a change to your reservation on the day of the service, such as moving the appointment time, a fee may be applied due to limited availability. If you are booking your massage within 24 hours of the actual appointment, and then there is a cancellation, you will be charged the full amount of the appointment. Payment methods: Payments accepted include credit/debit cards, cash, and personal checks. Any returned checks will be charged a $35 fee and must be resolved within 5 business days of notification. If not resolved, the check will be turned over to the authorities for prosecution. Also, I reserve the right to no longer accept personal checks from individuals that I receive a returned check notification in the future.
LATE ARRIVAL POLICY To be fair and courteous to all clients, appointments will be automatically cancelled 15 minutes after scheduled start time and charged according to cancellation policy. If possible, we will accommodate a partial appointment. This will be at our discretion and only with proper, advanced notification of your late arrival.
SCOPE OF PRACTICE Brittnee Phillips, LMT is a licensed professional and holds herself to the highest standards of the American Massage Therapy Association and the Alabama Board of Massage Therapy. Massage Therapy is a profession in which the scientific manipulation of the soft tissues of the body for the purpose of normalizing those tissues and consists of manual techniques that include applying fixed or movable pressure, holding, and/or causing movement of or to the body, with the intention of positively affecting the health and well-being of the client.
Massage Therapists do not diagnose illness, disease or any other physical or mental disorder. As such, I do not prescribe medical treatment or pharmaceuticals nor is any spinal adjustment performed. Massage therapy is not a substitute for medical attention, and it is essential that all health information provided be true and correct. Nor am I allowed to provide treatment for a specific condition without a doctor's supervision. The massage therapist is required to refer you for diagnosis and to follow recommendations of your physician.
REFUND POLICY If a cancellation occurs more than 24 hours in advance, rescheduling will occur for my clients without a refund. Please note that there is a rescheduling limit of 3 times. Once a person cancels and reschedules 3 times and does NOT attend the session, all monies are forfeited. No refunds will be provided for monies paid or cancellations received less than 24 hours before a scheduled appointment. No refunds are provided after services have been rendered. Cancellations (without rescheduling) received more than 1 week prior to the scheduled session are eligible for a 50% refund, and cancellations received less than 1 week prior to a scheduled event are eligible for a 25% refund. Brittnee Phillips, LMT reserves the right to make the final decision on any and all refunds issued.
SICKNESS POLICY Brittnee Phillips, LMT recognizes that both massage therapists and clients are vulnerable to infections and given that I ask clients to cancel appointments when they are feeling unwell and we will do the same for you. If you have any of the following contagious illnesses the massage session will be rescheduled: Diarrhea, Vomiting, Fever, Sore Throat, Poison Ivy, Flu, Chicken Pox, Head Lice, Impetigo, Ringworm, Common Cold or anything that is, or could be contagious please reschedule your appointment as soon as you are feeling ill. Cancellation fees will apply if we are within 24 hours of the scheduled appointment time. HOWEVER, we can credit those fees toward your next visit (due to sickness) if the appointment is rescheduled. If multiple cancellations/rescheduling occurs due to illness (3 times), then all monies are forfeited, without a credit toward another visit.
SEXUAL MISCONDUCT Sexual misconduct is forbidden. Clients understand that any illicit or sexually aggressive remarks, advances or gestures will result in the immediate termination of the session and client will be liable for full payment of the scheduled appointment and reporting to all authorities, as well as any other entities deemed necessary (licensing boards) will result.
RESPECT FOR CLIENT NEEDS AND BOUNDARIES The client may choose to leave on as much clothing as needed for comfort, refuse any massage methods, or stop the massage at any time and is free to leave; the treatment room doors will never be locked. The client will always be modestly draped. Only the area being massaged will be undraped. The clients will be kept informed of the area to be massaged. Occasionally, an emotional response to massage may occur. If this happens, it is absolutely ok to express those feelings in our safe, nonjudgmental environment - or you may request privacy and end the session. You are always in control of your massage session.
PROFESSIONAL BOUNDARIES Requests for sexual activity will not be tolerated, will be viewed as solicitation, and reported to the proper authorities if the therapist chooses, under the guidelines of the massage therapy policies and procedures. The client will not be rescheduled if this occurs. The breast and genital area will not be massaged under any circumstances. Permission will be asked before working close to these areas; otherwise, a professional distance will be maintained. Also, low back, hip & gluteal area will be massaged only with permission and can be worked through the draping if requested. Sexual interaction or discussion of any kind between the client and the massage therapist is NEVER appropriate. On rare occasions an involuntary sensual response to massage is natural and should subside on its own in a few moments. I do not massage anyone under the age of 17 without signed intake form from parent/legal guardian. Parent must be present for first session and must be the one to schedule the appointment(s) after the first session. Parent/legal guardian must be present in the room for anyone under the age of 16. We have the right to refuse service and therapist or client may end the session at anytime. If therapist ends session due to Sexual Misconduct full payment will be processed. If the therapist feels at any point their safety is compromised, the session will be stopped immediately and authorities may be called and full payment processed.
CONFIDENTIALITY AND CONVERSATION The discussion between the massage therapist and the client is confidential. The client may or may not choose to talk during the massage. I am happy to listen to your conversation and share my professional expertise. I prefer to not discuss topics of a political or private nature.
EXISTING AND NEW MEDICAL CONDITIONS It is the responsibility of the client to keep the massage therapist informed of any medical treatment (including surgery) or medications currently being taken, and to provide written permission from the physician, chiropractor, physical therapist, etc., as needed, that the massage may be continued. For the safety of my clients, massage services for those that have had surgery will not occur for a minimum of 6 weeks. A release from your physician that specifically states you may receive massage services will be required. The client must also keep the massage therapist informed of any changes in health conditions.
Refusal of Service
We may bar access to any service immediately, without prior notice or liability, under our sole discretion, without limitation, including but not limited to a breach of the Terms. We may bar access to any service if Dare to Dream Services/Leslie Phillips Seminars, Brittnee Phillips, LMT, believes that a customer conduct violates applicable law or is harmful to the interests of Dare to Dream Services/Leslie Phillips Seminars®, Brittnee Phillips, LMT and its subsidiaries. A violation that is harmful to the interests of Dare to Dream Services/Leslie Phillips Seminars®, Brittnee Phillips, LMT, includes but is not limited to: Video recording of live seminars, taking pictures of the screen during live presentations, copying of seminar materials given during attendance (handouts and other documentation) for distribution in a commercial capacity and/or using in a competitors live seminar business without written permission of Dare to Dream/Leslie Phillips Seminars®, Brittnee Phillips, LMT, and/or attempted recordings of massages.
You agree to indemnify and hold harmless Dare to Dream Services/Leslie Phillips Seminars®, Brittnee Phillips, LMT and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
Limitation Of Liability
In no event shall Dare to Dream Services/Leslie Phillips Seminars®, Brittnee Phillips, LMT, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Leslie Phillips Seminars, a program of Dare to Dream Services, makes every effort to produce quality seminars, but there are many ways to treat/interact with different customer populations and that all specific methods offered may not be the best approach for each individual customer. Also, while we do our best to provide quality seminars and are an NBCC and Alabama State Board of Examiner's in Social Work approved continuing education provider, we are not liable for continuing education hours not being credited by differing licensing boards of our customers. It is the customer's responsibility to ensure they attend seminars that will be accepted by their own licensing board. Dare to Dream Services/Leslie Phillips Seminars®, Brittnee Phillips, LMT, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components.
Accommodation/Modification Seminar Requests
Dare to Dream Services/Leslie Phillips Seminars® ADA Course Modification Policy In accordance with the Americans with Disabilities Act (ADA), Dare to Dream Services/Leslie Phillips Seminars® is committed to ensuring that there is no discrimination against individuals with disabilities on the basis of disability in the full and equal enjoyment of Dare to Dream Services/Leslie Phillips Seminars® goods, services, facilities, privileges, advantages, or accommodations. In furtherance of this commitment, Dare to Dream Services/Leslie Phillips Seminars® will offer seminars in an accessible manner to individuals with disabilities. 42 U.S.C. § 12189; 28 C.F.R. § 36.309. Dare to Dream Services/Leslie Phillips Seminars® will make modifications as are necessary to ensure that the place and manner in which the seminar is given are accessible to individuals with disabilities. Dare to Dream Services/Leslie Phillips Seminars® will provide appropriate auxiliary aids and services for persons with impaired sensory, manual, or speaking skills, unless we can demonstrate that offering a particular auxiliary aid or service would fundamentally alter the seminar or would result in an undue burden. (Undue burden is defined by ADA as "significant difficulty or expense"). If a specific communications method would be an undue burden, Dare to Dream Services/Leslie Phillips Seminars® will provide an effective alternative, if there is one. Dare to Dream Services/Leslie Phillips Seminars® will administer seminars that are accessible to individuals with disabilities or make alternative accessible arrangements. Alternative arrangements will provide comparable conditions to those provided for nondisabled individuals, such as, for example, the same opportunity to interact with an instructor, and ask questions. 28 C.F.R. § 36.309(c)(4)-(5).
The ADA Course Modification Coordinator is Leslie Phillips, LPC-S, NCC. Leslie Phillips is authorized to receive and review requests for modifications, auxiliary aids or services and can be reached at email@example.com.
Accommodations/Modifications Requests must be received in writing 60 days prior to the seminar date of choice for proper determination and resolution. Requests must be emailed to Leslie Phillips, firstname.lastname@example.org. Within one week of receiving a request, Dare to Dream Services/Leslie Phillips Seminars® through its ADA Course Modification Coordinator, will adhere to the following procedures for considering the request:
(1) Grant the request;
(2) Make a narrowly tailored request for more information about the request and, within three (3) days of receiving the information, grant or deny the request;
(3) Deny the request upon establishing that offering the particular auxiliary aid or service would fundamentally alter the seminar or would result in an undue burden, and/or offer alternative accessible arrangements.
Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.
These Terms shall be governed and construed in accordance with the laws of Alabama, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material changes, these can be made at any time, for any reason. Additionally, what constitutes a material change will be determined at our sole discretion. Customers will be notified of the changes via header/popup on front and/or landing page. Your continued use of the site/services denotes your agreement to the Terms of Service.
Continuing To Access Or Use Our Service
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
